Terms of Service

1. Acceptance of terms

By creating an account or using AI Catch (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Service.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• One human per account; sharing accounts is not permitted.
• We may suspend or terminate accounts that violate these terms.

4. Acceptable use

You agree not to use the Service to generate, request, upload, or share:

• NSFW, sexually explicit, adult, or pornographic content of any kind. This includes nudity, sexual acts, suggestive imagery, fetish content, and any pornographic depictions whether photorealistic, stylized, animated, or implied. This applies to all prompts, reference images, and outputs.
• Content that depicts minors (real or fictional, under 18) in any sexual, suggestive, or exploitative context. Zero tolerance.
• Content that targets a real, identifiable person without their explicit consent — including deepfakes, non-consensual intimate imagery, impersonation, or defamation.
• Content used for disinformation, election interference, fraud, harassment, hate speech, or incitement to violence.
• Content that violates third-party intellectual property, privacy, or publicity rights.
• Attempts to circumvent rate limits, billing, content moderation, or any other policy enforcement mechanism (including this content moderation system).

All prompts are screened by an automated content moderation system before generation. Violations may result in immediate, permanent account termination without refund. We cooperate with law enforcement on CSAM and other illegal content.

5. Intellectual property

You retain ownership of inputs you submit (prompts, reference images). Subject to your plan, you receive a commercial license to use generated outputs. Each underlying model may impose its own content rules, which we pass through.

6. Subscription & billing

Paid plans are billed in advance via Creem.io as Merchant of Record. Refunds are governed by our Refund Policy.

7. Termination

You may cancel your subscription at any time. We may terminate accounts that materially breach these terms.

8. Disclaimer & liability

THE SERVICE IS PROVIDED “AS IS”. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these terms shall be resolved exclusively in the courts of Hong Kong.

10. Changes

We may update these terms. Material changes will be announced via email or in-app at least 14 days before they take effect.
